Let PROCOM Show You The Basics
How Non-DOT Drug Testing Works for Employers and Individuals
Unlike DOT-regulated testing, a non DOT drug test refers to any drug or alcohol screening not governed by federal Department of Transportation rules. These programs are often used by private employers, utility companies, government contractors, and businesses in industries like construction, manufacturing, and energy.
A non DOT drug screen allows you to set your own drug-free workplace policies while remaining compliant with state or local laws. Whether you need to test for marijuana, opioids, or expanded panels, PROCOM helps ensure your program is consistent, legally sound, and tailored to your workforce.

Answers to Your FAQs About Non-DOT Drug Testing
We’re Always Here to Help Educate and Guide Clients
What is the difference between DOT and non-DOT drug testing?
DOT drug testing is governed by federal regulations under 49 CFR Part 40 and requires a standardized 5-panel urine test, a SAMHSA-certified laboratory, and mandatory testing for cannabis and alcohol. Non-DOT drug testing is governed by state law and employer policy. Non-DOT employers can choose any substances to test for, any collection method, any panel configuration, and set their own consequences for a positive result.
What kinds of drug tests do you use for non-DOT substance screening?
PROCOM offers multiple drug testing methods tailored to your organization’s needs:
Urine tests – The most common type of non-DOT drug test. Easy to administer, though it may carry a risk of tampering.
Saliva tests – Quick and minimally invasive, these tests detect recent drug use in a 24–48 hour window.
Hair follicle tests – Highly accurate and tamper-resistant. Detects long-term drug use going back up to 90 days.
Breathalyzer – Primarily used for alcohol screening. Fast results, often used for post-incident or reasonable suspicion cases.
Each method has different detection windows and uses. We’ll help you decide which non-DOT drug screen best fits your goals.
Can you help customize a drug testing program for my business?
Yes. We partner with employers to design non-DOT drug and alcohol screening programs aligned with your specific industry, budget, and goals. Whether you’re starting from scratch or revising an existing policy, PROCOM offers:
Consortium/TPA management
State-compliant protocols
Training and implementation support
We ensure your testing program is both practical and compliant.
Do non-DOT employers have to use a SAMHSA-certified laboratory?
No. SAMHSA-certified laboratories are required for DOT drug testing but are not federally mandated for non-DOT programs. However, PROCOM uses SAMHSA-certified laboratories for all testing, both DOT and non-DOT, because they represent the industry gold standard for accuracy and defensibility. Using a certified laboratory for non-DOT testing provides maximum legal protection if results are ever challenged.
Can non-DOT employers choose which drugs to test for?
Yes. Non-DOT employers have complete flexibility in selecting which substances to include in their drug testing panel. PROCOM offers hundreds of panel configurations and can build a fully custom panel based on the substances of concern in your specific industry or workforce. Employers can also remove substances from standard panels, such as removing THC in states where marijuana is legal.
Can non-DOT employers test for marijuana in Colorado?
Yes. Colorado employers retain the right to enforce drug-free workplace policies that include marijuana, even though recreational marijuana is legal in the state. Non-DOT employers can include or exclude THC from their testing panel based on their workplace policy. Some employers choose to remove THC from their panel, while others maintain it as a tested substance. PROCOM can help you build a panel and policy that reflects your position.
What happens if you fail a non-DOT drug test?
If an employee fails a non-DOT drug test, it’s up to the employer to determine next steps based on their internal policy. Since these tests are not federally regulated, the consequences vary—but may include:
Retesting or confirmation testing
Disciplinary action
Termination or referral to a treatment program
PROCOM can help you craft a clearly defined follow-up process as part of your non-DOT screening program to protect your workplace and employees.
